Henry Brooks Adams (February 16, 1838 - March 27, 1918) was an American historian and member of the Adams political family, being descended from two U.S. Presidents.As a young Harvard graduate, he was secretary to his father, Charles Francis Adams, Abraham Lincoln's ambassador in London, a posting that had much influence on the younger man, both through experience of wartime diplomacy and absorption in English culture, especially the works of John Stuart Mill. After the American Civil (...) The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. Within contemporary philosophy of mind, it is taken for granted that externalist accounts of meaning and mental content are, in principle, orthogonal to the matter of whether cognition itself is bound within the biological brain or whether it can constitutively include parts of the world. Accordingly, Clark and Chalmers (1998) distinguish these varieties of externalism as ‘passive’ and ‘active’ respectively. The aim here is to suggest that we should resist the received way of thinking about these dividing lines. With reference (...) to Brandom’s (1994; 2000; 2008) broad semantic inferentialism, we show that a theory of meaning can be at the same time a variety of active externalism. While we grant that supporters of other varieties of content externalism (e.g., Putnam 1975 and Burge 1986) can deny active externalism, this is not an option for semantic inferentialists: On this latter view, the role of the environment (both in its social and natural form) is not ‘passive’ in the sense assumed by the alternative approaches to content externalism. This essay examines the contrasting conceptualizations of reason in the thought of John Henry Newman and Andrew Martin Fairbairn in their articles published in The Contemporary Review in 1885. This essay articulates both Fairbairn’s charge of philosophical scepticism against Newman as well as Newman’s defense of his position and concomitantly details Fairbairn’s and Newman’s competing notions of the efficacy of reason to provide reliable knowledge of God. Formalised knowledge systems, including universities and research institutes, are important for contemporary societies. They are, however, also arguably failing humanity when their impact is measured against the level of progress being made in stimulating the societal changes needed to address challenges like climate change. In this research we used a novel futures-oriented and participatory approach that asked what future envisioned knowledge systems might need to look like and how we might get there. Findings suggest that envisioned future systems will need (...) to be much more collaborative, open, diverse, egalitarian, and able to work with values and systemic issues. They will also need to go beyond producing knowledge about our world to generating wisdom about how to act within it. To get to envisioned systems we will need to rapidly scale methodological innovations, connect innovators, and creatively accelerate learning about working with intractable challenges. We will also need to create new funding schemes, a global knowledge commons, and challenge deeply held assumptions. To genuinely be a creative force in supporting longevity of human and non-human life on our planet, the shift in knowledge systems will probably need to be at the scale of the enlightenment and speed of the scientific and technological revolution accompanying the second World War. This will require bold and strategic action from governments, scientists, civic society and sustained transformational intent. (shrink)

This paper aims to do two things. First, it describes the place that Adam Smith actually occupies in current research occurring at the boundaries of new interdisciplinary social-science fields such as evolutionary anthropology, evolutionary psychology, neuro-economics and behavioral economics. Second, it suggests a way in which Smith's place in the debates with which these subjects are concerned may be more properly defined and conceptualized. John F. Henry is an eminent economist who has made important contributions to heterodox economics drawing on Adam Smith, Karl Marx, Thorstein Veblen, and John Maynard Keynes. His historical approach offers radical insights into the evolution of ideas (ideologies and theories) giving rise to and/or induced by the changes in capitalist society. Essays collected in this festschrift not only evaluate John Henry's contributions in connection to Marx's and Veblen's theories, but also apply them to the socio-economic issues in (...) the 21st century. Essays in this book, individually and collectively, make an important point that the history of economic thought (or historical analysis of economic theory and policy) is an integral part of developing heterodox economics as an alternative theoretical framework. In this article, we propose the Fair Priority Model for COVID-19 vaccine distribution, and emphasize three fundamental values we believe should be considered when distributing a COVID-19 vaccine among countries: Benefiting people and limiting harm, prioritizing the disadvantaged, and equal moral concern for all individuals. The Priority Model addresses these values by focusing on mitigating three types of harms caused by COVID-19: death and permanent organ damage, indirect health consequences, such as health care system strain and stress, as well as (...) economic destruction. It proposes proceeding in three phases: the first addresses premature death, the second long-term health issues and economic harms, and the third aims to contain viral transmission fully and restore pre-pandemic activity. -/- To those who may deem an ethical framework irrelevant because of the belief that many countries will pursue "vaccine nationalism," we argue such a framework still has broad relevance. Reasonable national partiality would permit countries to focus on vaccine distribution within their borders up until the rate of transmission is below 1, at which point there would not be sufficient vaccine-preventable harm to justify retaining a vaccine. When a government reaches the limit of national partiality, it should release vaccines for other countries. -/- We also argue against two other recent proposals. Distributing a vaccine proportional to a country's population mistakenly assumes that equality requires treating differently situated countries identically. Prioritizing countries according to the number of front-line health care workers, the proportion of the population over 65, and the number of people with comorbidities within each country may exacerbate disadvantage and end up giving the vaccine in large part to wealthy nations. The progress of electronic health technologies and biobanks holds enormous promise for efficient research. Evidence shows that studies based on sharing and secondary use of data/samples have the potential to significantly advance medical knowledge. However, sharing of such resources for international collaboration is hampered by the lack of clarity about ethical and legal requirements for transfer of data and samples across international borders. Here, the International Clinical Trial Center Network reports the legal and ethical requirements governing data and sample exchange (...) across four continents. The most recurring requirement is ethical approval, whereas only in specific conditions approval of national health authorities is required. Informed consent is not required in all sharing situations. However, waiver of informed consent is only allowed in certain countries/regions and under certain circumstances. The current legal and ethical landscape appears to be very complex and under constant evolution. Regulations differ between countries/regions and are often incomplete, leading to uncertainty. With this work, ICN illuminates the unmet need for a single international collaborative framework to facilitate DSE. Harmonising requirements for global DSE will reduce inefficiency and waste in research. There are many challenges to realising this ambitious vision, including inconsistent terminology and definitions, and heterogeneous and dynamic legal constraints. Here, we identify areas of agreement and significant difference as a necessary first step towards facilitating international collaboration. We propose the establishment of a working group to continue the comparison across jurisdictions, create a standardised glossary and define a set of basic principles and fundamental requirements for DSE. Antimicrobial resistance (AMR) has become one of the defining challenges of the twenty-first century. Food production and farming are a key if troubling component of that challenge. Livestock production accounts for well over half of annual global consumption of antimicrobials, though the contribution of the sector to drug resistance is less clear. As a result, there is an injunction to act in advance of incontrovertible evidence for change. In this paper we engage with the role of market actors in the (...) precautionary regulation of farming practices and AMR threats. The paper takes the UK poultry sector as exemplary of an audit-led process that has, in recent years, achieved impressive reductions in antimicrobial use. Using qualitative interview data with farmers and veterinarians we chart the changing practices that have accompanied this reduction in treatments. We use this analysis to raise some cautions around audit-led systems of regulation. Audits can lock farms and animals into particular versions of farming and animal health; they can elevate harmful compensatory practices (including disinfectant uses); and they can reproduce an actuarial approach to an issue that does not fit the conventions of risk management. The paper presents the considerable successes that have been achieved over a short period of time in a livestock sector, while generating notes of caution concerning the audit-led management of livestock-related AMR threats. ‘Apologetics’ is hardly a word to be used without apology in the present dispensation. And to speak of anything like a neglected avenue or opportunity in religious apologetics might almost seem as if one were speaking of an opportunity in just such an enterprise as no self-respecting philosopher would nowadays wish even to be associated with. For all of their avoidance of the term, however, the thing designated by the term is something with which not a few philosophers of recent (...) years have been not above dabbling in, albeit usually under other names and other labels. After all, religious language has now come to be recognized as not just a legitimate, but even a fashionable object of philosophic attention. And a concern with religious language has often brought with it a concern with religious attitudes, religious behaviour, religious argumentation — yes, even to the point of occasionally becoming a concern with the very religious realities themselves that religious language, religious attitudes, religious behaviour, and religious argument are presumably all about. True, religious realities in this sense are to today's garden of philosophy pretty much what the tree of knowledge once was to the garden of Eden. In fact, one even suspects that there could be a serpent about somewhere, for cases have been reported of an occasional philosopher Adam or philosopher Eve having yielded to temptation: a consideration of God-talk has been known to lead to cautious admissions that such talk might be cognitively meaningful; a consideration of God-experiences to the admission that such experiences under certain circumstances could be veridical; or, even more rarely, a consideration of proofs for God's existence to the gingerly admission that at least some of these proofs might just possibly be valid. Needless to say, though, such a yielding to temptation on the part of some few contemporary philosophers, while it may not have led to any manifest sewing together of fig-leaves, has certainly brought with it the danger, if not always the reality, of a supercilious expulsion from the glorious Eden of contemporary professional philosophy. Throughout the biological and biomedical sciences there is a growing need for, prescriptive ‘minimum information’ (MI) checklists specifying the key information to include when reporting experimental results are beginning to find favor with experimentalists, analysts, publishers and funders alike. Such checklists aim to ensure that methods, data, analyses and results are described to a level sufficient to support the unambiguous interpretation, sophisticated search, reanalysis and experimental corroboration and reuse of data sets, facilitating the extraction of maximum value from data sets (...) them. However, such ‘minimum information’ MI checklists are usually developed independently by groups working within representatives of particular biologically- or technologically-delineated domains. Consequently, an overview of the full range of checklists can be difficult to establish without intensive searching, and even tracking thetheir individual evolution of single checklists may be a non-trivial exercise. Checklists are also inevitably partially redundant when measured one against another, and where they overlap is far from straightforward. Furthermore, conflicts in scope and arbitrary decisions on wording and sub-structuring make integration difficult. This presents inhibit their use in combination. Overall, these issues present significant difficulties for the users of checklists, especially those in areas such as systems biology, who routinely combine information from multiple biological domains and technology platforms. To address all of the above, we present MIBBI (Minimum Information for Biological and Biomedical Investigations); a web-based communal resource for such checklists, designed to act as a ‘one-stop shop’ for those exploring the range of extant checklist projects, and to foster collaborative, integrative development and ultimately promote gradual integration of checklists. In this book, Charles Griswold attempts to make Adam Smith speak to a postmodern generation by taking an extended detour through antiquity. The frames of reference that pervade his long, thoughtful, unfailingly engaging, though not concisely written book include next to nothing about the significance of a "sympathy" theory for modern social psychology, or about evolutionary theory or modern economic theory. Nor is much effort made to pin down the eighteenth-century context of Smith's enterprise. Instead, the book takes Smith primarily (...) as a moral philosopher in the grand Western tradition, while nonetheless arguing for the deep meaningfulness of such a Smith to a postmodern audience. First, it suggests that Anglophone appropriations of Lefebvre have tended to focus too much on his urban writings, at the expense of understanding his early work on rural sociology, and failing to recognise how his urban focus emerged as a result of his interest in rural–urban transformation. Second, it provides a summary of his wider work on rural questions, (...) including his unfinished work on a major treatise of rural sociology; and outlines the key themes of the present essay in relation to these other projects. One of the many narratives of twentieth century philosophy regards the relationship of philosophy to science: the opinions and arguments over whether philosophy as a discipline should be an assistant, critic, or master over science, and what particular ways philosophy could articulate these roles. One can interpret most of the major conflicts and disciplinary divisions of philosophy as having to do with its relationship with science. The conceptual roots of the general acceptability of a convergence of science and metaphysics would (...) appear to lie in the focus of both subjects, broadly conceived: investigating the nature of existence. Yet, after the rise of post-modernism in many humanities fields, dialogue between philosophy and science on many important issues has become impossible, scientifically-minded intellectuals having no expectation that humanities can contribute usefully to the disciplines of science. Henry Home (1696-1782) has been called "perhaps the most complete 'Enlightenment man' among the eighteenth-century Scottish thinkers." Kinsman and friend of David Hume, mentor and patron of Adam Smith, John Millar, and Thomas Reid, he was a key figure in that circle of luminaries. He read law, was called to the bar in 1723, was raised to the Bench of the Court of Session in 1752, with the title Lord Kames (the name of his family estate), and joined the (...) High Court of the Justiciary in 1763. Publishing broadly in law, history, philosophy, and criticism, Kames made significant contributions to the Enlightenment's science of human nature. The Essays is commonly considered Kames's most important philosophical work. In the first part, he sets forth the principles and foundations of morality and justice, attacking Hume's moral skepticism and addressing the controversial issue of the freedom of human will. In the second part, Kames focuses on questions of metaphysics and epistemology to offer a natural theology in which the authority of the external senses is an important basis for belief in the Deity. The text of this volume is based on the third edition of 1779, while the appendix presents substantial variant readings in the first and second editions. (shrink)

What, as readers or interpreters, may come off in our hands in as we maculate or mark the books we read? For Adam Zachary Newton, reading is anembodied practice wherein "ethics" becomes a matter of tact in the doubled sense of touch and regard. With the image of the book lying in the hands of its readers as insistent refrain, To Make the Hands Impure (...) cuts a provocative cross-disciplinary swath through classical Jewish texts, modern Jewish philosophy, film and performance, literature, translation, and the material text. In separate chapters, he conducts masterly treatments of Emmanuel Levinas, Mikhail Bakhtin, and Stanley Cavell by emphasizing their performances as readers a trebled orientation to Talmud, novel, and theater/film. To Make the Hands Impure stages the encounter of literary experience and scriptural traditions he difficult and the holy through an ambitious, singular, and innovative approach marked in equal measure by erudition and imaginative daring. Consider the following examples of political activity: Immediately upon the recent passage of health care reform legislation by the United States House of Representatives, announcements were made by attorneys general in several states that they would be challenging the constitutionality of the law in court. South Carolina Attorney General Henry McMaster thus contended that the "health care legislation Congress passed tonight is an assault against the Constitution. A legal challenge by the states appears to be the only hope of (...) protecting the American people from this unprecedented attack on our system of government." While the specifics of the proposed lawsuits varied, they were united in their goal of overturning the new law via court decision. In so doing, they were advancing a particular line of argument against that bill to the public—an argument that appealed to the alleged conflict between the legislation and the United States Constitution. Abstract:This essay explores ways that looming climate change will affect how we think about future winters in New England. By all accounts, by the end of the twenty-first century the depth of the region's winter snow and cold will be much reduced from their historical averages. Drawing upon personal reflection, scientific data, and close readings of iconic New England authors, the essay examines potential future conceptions of the region's winters. I am particularly interested in how the expected warmer winters will (...) demand rereading literary works by iconic figures such as Emily Dickinson, Henry David Thoreau, and Robert Frost. The essay begins with an examination of the role nostalgia has played in popular images of New England winters and argues for a critically informed version of nostalgia that will enable readers to mourn for what they might lose in the future. The concluding section examines the folklore behind the January Thaw. Climate change, I argue, will usher in a period of an ongoing New England thaw to which our poetry and natural history writing will have to adapt. (shrink)
